Woman accuses Lincoln National Life Insurance Co. of wrongfully denying benefits

Insurance 05

BATON ROUGE – A Breaux Bridge woman alleges her claim for disability benefits was wrongfully denied by her insurer.

Alicia M. Coley filed a complaint on Sept. 6 in the U.S. District Court for the Middle District of Louisiana against Lincoln National Life Insurance Co. alleging that the plan administrator violated the Louisiana Insurance Code.

According to the complaint, the plaintiff alleges that due to her chronic conditions, she stopped working on Jan. 31, 2014. She alleges she provided defendant with proof of loss but she was not granted disability benefits, causing her to suffer financial and emotional hardship. The plaintiff holds Lincoln National Life Insurance Co. responsible because the defendant allegedly denied her claim for benefits despite receipt of overwhelming proof of her disability conditions and refused to promptly and fairly adjust and pay the claim.

The plaintiff requests a trial by jury and seeks judgment against defendant for all damages, plus pre- and post-judgment interest, attorney fees and court cost and for all other relief as the court may provide. She is represented by Willeford & Toledano and James F. Willeford of Willeford & Toledano in New Orleans.
