NEW ORLEANS — A motorist severely injured in a motor vehicle accident has filed suit against an insurance company for alleged breach of contract.
Michel Cathryn Hart filed a complaint Sept. 14 in U.S. District Court for the Eastern District of Louisiana against Automobile Club Inter-Insurance Exchange, alleging that the automobile insurer failed to comply with its contractual agreement.
According to the complaint, the plaintiff alleges that on Sept. 20, 2014, she sustained severe permanent injuries in a motor vehicle accident caused by the negligent conduct committed by an underinsured drunk driver. State Farm paid out its policy limits on April 14, 2015. She seeks compensatory recovery from the defendant for all underinsured covered losses. The plaintiff holds Automobile Club Inter-Insurance Exchange responsible because the defendant allegedly failed to pay the plaintiff's compensatory damages.
The plaintiff requests a trial by jury and seeks judgment against the defendant for all sums reasonable in the premises, together with legal interest, for all costs of these proceedings and for all other equitable relief.
