Jefferson Parish man says NBA player's trailer door crushed legs, preventing him from working

NEW ORLEANS — A Jefferson Parish parking attendant is suing an NBA player and an insurance company, citing alleged failure to warn and insufficient measures were taken to prevent injuries.

Nicholas Martinez filed a complaint in the U.S. District Court for the Eastern District of Louisiana against Dante Cunningham and ABC Insurance Company alleging that the NBA player and insurer failed to use reasonable care.

According to the complaint, the plaintiff alleges that on April 18, he was injured when the cargo door of the defendant's transport trailer crushed his legs. He was unable to work because of his injuries. He has suffered pain and suffering, medical expenses, disability and loss wages. The plaintiff holds Dante Cunningham and ABC Insurance Company responsible because they allegedly failed to warn him of the dangerous condition, failed to use due care and failed to properly maintain the transport trailer in a safe condition.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly, severally, and in solido, in an amount reasonable in the premise, plus all costs of these proceedings and for all general and equitable relief.
