NEW ORLEANS – Kenner residents have filed a class-action lawsuit alleging that a solar company misrepresented loans in order to induce them into purchasing a solar energy system.
Todd Alfortish and Sylvia Alfortish filed a complaint on behalf of all others similarly situated on Sept. 30 in the U.S. District Court for the Eastern District of Louisiana against GreenSky LLC and SunTrust Bank Inc. alleging that they violated the Louisiana Unfair Trade Practices and Consumer Protection Law and other counts.
According to the complaint, the plaintiffs allege that they suffered damages for entering into a finance agreement with defendants to purchase solar energy systems with interest and without receiving the promised state income tax credit. The plaintiffs holds GreenSky LLC and SunTrust Bank Inc. responsible because the defendants allegedly falsely promised incentives of energy savings, guaranteed federal and state income tax refunds and failed to disclose that the loans were not interest free.
The plaintiffs request a trial by jury and seek an order certifying the plaintiff class, appointing plaintiffs and their counsel as representatives, award for actual damages, prejudgment interest, attorney's fees, costs and expense and such other relief as the court deems appropriate.
