BATON ROUGE – A temporary foreign worker hired for landscape work at an Ascension Parish alleges he was not paid the proper rate for overtime work.
Arnoldo Pineda filed a complaint on Oct. 4 in the U.S. District Court for the Middle District of Louisiana against Green Escapes Nursery Inc. and Don Broussard alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he regularly worked in excess of 40 hours per week without being paid overtime wages. The plaintiff holds Green Escapes Nursery Inc. and Broussard responsible because the defendants allegedly failed to pay proper overtime compensation at the rate of one-and-one-half times his regular pay for all hours worked in excess of 40 per week. He alleges the defendants would make applicable payroll deductions from his check, then pay him his regular wage rate for the extra hours in cash.
The plaintiff requests a trial by jury and seeks compensation for unpaid overtime wages, an equal sum as liquidated damages, plus interest, attorneys' fees and for all costs of this proceeding. He is represented by Daniel B. Davis and Randall E. Estes of Estes Davis Law LLC in Baton Rouge.
