BleachBright LLC alleges it did not infringe patents for teeth whitening mouthpieces

NEW ORLEANS – A Kenner teeth whitening products supplier accused of patent infringement by a New York company is seeking the court's help.

BleachBright LLC filed a complaint on Oct. 5 in the U.S. District Court for the Eastern District of Louisiana against GLO Science Inc. and JBL Radical Innovations LLC seeking declaratory judgment of non-infringement of patents.

According to the complaint, the plaintiff alleges that it has suffered injuries for being threatened with a charge of patent infringement. The plaintiff holds GLO Science Inc. and JBL Radical Innovations LLC responsible because the defendants allegedly claimed a monopoly over all mouthpieces used for teeth whitening purposes and asserted that plaintiff’s IBRIGHT is similar and may infringe defendants' ’074 and ’255 design patents. The plaintiff alleges that the defendants have not provided an analysis as to how their products and the plaintiff's are similar.

The plaintiff requests a trial by jury and seeks declaratory judgment of non-infringement of defendants' design patents, permanently enjoining defendants from filing any charge of infringement, award for costs and expenses in this action.
