Woman seeks rescission of Dodge truck she alleges is defective

NEW ORLEANS – A Louisiana woman alleges a truck she purchased has numerous defects.

Danielle N. Armstrong filed a complaint on Oct. 5 in the U.S. District Court for the Eastern District of Louisiana against FCA US LLC alleging violation of the Magnuson-Moss Warranty Act, negligent repair and other counts.

According to the complaint, the plaintiff alleges that on Feb. 25, she purchased a new 2016 Dodge Ram 2500. When delivered, she alleges the truck was defective in materials and workmanship and that the defects substantially impaired its use, value and safety. The plaintiff holds FCA US LLC responsible because the defendant allegedly failed to repair the Ram 2500 in a good and workmanlike manner and within a reasonable time so as to bring it into conformity with the warranties and failed and refused to buy back plaintiff's defective vehicle.

The plaintiff requests a trial by jury and seeks complete rescission of the sale of the subject vehicle, award for all damages, any diminution in value, economic losses, costs and litigation expenses and all other relief the court deems appropriate.
