Man alleges Pinnacle recreational vehicle is defective, seeks rescission of sale contract

BATON ROUGE – A consumer alleges a recreational vehicle he purchased from a Monroe business is defective.

Jeffrey S. Ritchie filed a complaint on Oct. 5 in the U.S. District Court for the Middle District of Louisiana against Jayco Inc. of Indiana, Hope's Camper Corner Inc. and Iberia Bank alleging that they violated the Magnuson-Moss Warranty Act and other counts.

According to the complaint, the plaintiff alleges that in March 3, 2015, he purchased a new 2015 Jayco 38 FLSA Pinnacle for personal use from Hope's Camper Corner Inc. When delivered, the Pinnacle was allegedly defective in materials and workmanship and that such defects substantially impaired its use, value and safety. The plaintiff holds Jayco Inc. of Indiana, Hope's Camper Corner Inc. and Iberia Bank responsible because the defendants allegedly failed to repair the vehicle in a good and workmanlike manner so as to bring it into conformity with its warranties and failed and refused to buy back the defective vehicle.

The plaintiff requests a trial by jury and seeks judgment against defendants for all damages, rescission for the sale of the subject vehicle, for incidental and consequential damages, diminution in value, economic losses, litigation expenses and all other relief that the court deems appropriate.
