Lady of the Sea General Hospital sued over unfair termination

NEW ORLEANS — A medical staff coordinator is suing Lafourche Parish Hospital Service District No. 1, d/b/a Lady of the Sea General Hospital and Bennie Smith, employer and supervisor, citing alleged unlawful employment practices.

Christine Hartman filed a complaint on Oct. 12, in the U.S. District Court for the Eastern District of Louisiana against the defendants alleging that they violated the the Louisiana Employment Discrimination Law.

According to the complaint, the plaintiff alleges that, on April 26, upon her return to work after she cared for her husband, who just underwent a stem cell transplant, defendant Smith terminated her employment, claiming she made errors on paperwork. Plaintiff has suffered a loss of income and benefits and mental anguish.

The plaintiff holds Lafourche Parish Hospital Service District No. 1, d/b/a Lady of the Sea General Hospital and Bennie Smith responsible because the defendants allegedly subjected her to adverse employment action by discriminating and retaliating against her and terminating her employment because she exercised her rights under the Family and Medical Leave Act.

The plaintiff requests a trial by jury and seeks monetary judgment for compensatory damages, plus liquidated damages, injunctive and equitable relief, costs of suit and such other relief as may be just. She is represented by Robert B. Landry III of Robert B. Landry III PLC in Baton Rouge.
