Man alleges U.S. Impact mailed misleading collection letter

Late 06

NEW ORLEANS – A St. John the Baptist Parish man claims a Mandeville debt collector mailed him a letter with misleading representations regarding an alleged debt.

Lloyd Hughes filed a complaint on Oct. 12 in the U.S. District Court for the Eastern District of Louisiana against U.S. Impact Inc. citing the Louisiana Unfair Trade Practices and Consumer Protection Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Aug. 23, he received a letter from defendant attempting to collect an alleged remaining debt from a terminated construction contract. The plaintiff holds U.S. Impact Inc. responsible because the defendant allegedly made demands for amounts he does not owe and used unfair methods of competition and unfair or deceptive practices and misrepresented the character and amount of the alleged debt.

The plaintiff requests a trial by jury and seeks an order requiring defendant to cease and desist all collection efforts against his alleged debt, compensation for all damages, attorney’s fees and costs and any other relief that the court deems appropriate. He is represented by Galen M. Hair of Varadi, Hair & Checki LLC in New Orleans.
