NEW ORLEANS – A Kenner woman alleges her disability benefits were wrongfully terminated.
Donna C. Richardson filed a complaint on Oct. 14 in the U.S. District Court for the Eastern District of Louisiana against Prudential Insurance Co. of America alleging violation of the Employment Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she has suffered and is continuing to suffer economic losses because the benefits due to her under the disability plan were terminated. The plaintiff holds Prudential Insurance Co. of America responsible because the defendant allegedly failed to consider her medical condition and unlawfully denied her benefits she is entitled to under terms of the disability policy.
The plaintiff requests a trial by jury and seeks judgment against defendant for all benefits due under the plan, plus interest, reasonable attorney fees, costs of suit and all other relief as the law may provide. She is represented by James F. Willeford and Reagan L. Toledano of Willeford & Toledano in New Orleans.
