Man alleges Lincoln National Life wrongfully terminated disability benefits

ALEXANDRIA – An Avoyelles Parish man alleges his disability benefits were wrongfully terminated by his insurer.

Curnis Walker filed a complaint on Oct. 13 in the U.S. District Court for the Western District of Louisiana Alexandria Division against The Lincoln National Life Insurance Co. alleging violation of the Employment Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he received short and long-term disability benefits from the defendant from 2012 to 2015. The plaintiff holds The Lincoln National Life Insurance Co. responsible because the defendant allegedly wrongfully terminated his benefits under the long-term disability plan on March 10, 2015, and on Nov. 2, 2015, it denied his appeal and refused to pay him any further benefits.

The plaintiff seeks judgment in his favor for all amounts legally due and owing under the disability insurance policy, a declaration that he is an eligible participant under defendant’s group policy and is entitled to receive monthly benefits, award for all costs of these proceedings and all other equitable relief. He is represented by Daniel E. Broussard Jr. of Broussard, Halcomb & Vizzier in Alexandria.
