Man alleges he was wrongfully terminated by Terrebonne Parish because of results of drug test

NEW ORLEANS – A Houma man alleges he was terminated by his employer of more than 30 years because of the results of a botched drug test.

Terry Allen Parks filed a complaint on Oct. 12 in the U.S. District Court for the Eastern District of Louisiana against Terrebonne Parish Consolidated Government, Multi-Management Services Inc., Alere Toxicology Services Inc. and Brian N. Heinen alleging that they violated the Fourth and 14th Amendment to the U.S. Constitution.

According to the complaint, the plaintiff alleges that on Oct. 12, 2015, as a result of defendants MMSI, Alere, and Heinen's negligence in administering a random drug test on him, he tested positive for marijuana and was terminated from his employment wit Terrebonne Parish Consolidated Government. He alleges he has suffered lost wages and benefits, mental anguish and emotional distress and loss of enjoyment of life.

The plaintiff holds Terrebonne Parish Consolidated Government, Multi-Management Services Inc., Alere Toxicology Services Inc. and Heinen responsible because defendants MMSI, Alere, and Heinen allegedly removed plaintiff's specimen from his sight during the test, failed to have the plaintiff mark it with tamper-proof labels and failed to reject the test because of these reasons.

The plaintiff requests a trial by jury and seeks reinstatement in the same or in a similar position, award for all damages, attorney’s fees, litigation expenses and cost and such other and further relief as the court deems just. He is represented by J. Arthur Smith III and Justin M. Delaune of Smith Law Firm in Baton Rouge.
