BATON ROUGE – A disabled St. James man alleges that an Ascension Parish shopping center operator has discriminated against him by denying him a safe and full access the its property.
Milton Cayette filed a complaint on Oct. 19 in the U.S. District Court for the Middle District of Louisiana against Brookside Properties Inc. of Tennessee citing the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that on Aug. 3, he visited defendant's property and experienced serious difficulty accessing the goods and utilizing the services offered therein. The plaintiff holds Brookside Properties Inc. of Tennessee responsible because the defendant allegedly failed to provide safe, easy and accessible ramps and failed to remove and/or alter the mobility-related barriers.
The plaintiff requests a trial by jury and seeks an order directing defendant to alter the property to make it accessible to and useable by individuals with disabilities, award for attorneys’ fees, costs and expenses and such other relief as it deems necessary by the court.
