NEW ORLEANS – Three men allege their former employer discriminated against them because of their gender and Middle Eastern national origin.
Khalid Sharaf, Ahmad Elaal and Jamal Atiya filed a complaint on Oct. 19 in the U.S. District Court for the Eastern District of Louisiana against Ruby Enterprises LLC and Nadia Esmai alleging violation of the Fair Labor Standards Act, the Age Discrimination in Employment Act and the Louisiana Employment Discrimination Law.
According to the complaint, the plaintiffs allege that they regularly worked for more than 40 hours in a workweek during their employment and were not paid the proper overtime wages. They also allege they were subjected to discrimination and harassment on the basis of their gender, age, and national origin, race, and color. The plaintiffs holds Ruby Enterprises LLC and Esmai responsible because the defendants allegedly unlawfully misclassified them as exempt employees under the FLSA, failed to pay all their wages due under the terms of their employment and retaliated against them by terminating their employment.
The plaintiffs request a trial by jury and seek compensation for lost wages and fringe benefits, liquidated damages, attorney’s fees, costs, prejudgment and post-judgment interest and any other legal and equitable relief that is proper.
