MC Spa Franchise LLC alleged to have misrepresented franchise information

NEW ORLEANS – A Marrero franchisee alleges its Florida-based franchisors misrepresented and omitted information about the franchise.

Tus' Investment LLC filed a complaint on Oct. 20 in the U.S. District Court for the Eastern District of Louisiana against MC Spa Franchise LLC, Mary Chau and Andy Chau alleging fraudulent misrepresentation, negligent misrepresentation, unjust enrichment and other counts.

According to the complaint, the plaintiff alleges that as a result of defendants' negligent misrepresentations, plaintiff has been substantially damaged for not receiving the benefits of the franchise agreement. The plaintiff holds MC Spa Franchise LLC, Mary Chau and Andy Chau responsible because the defendants allegedly fraudulently induced plaintiff to execute the franchise agreement by supplying incorrect information and failed comply with the terms of their franchise agreements.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly, severally and in solido, in an amount reasonable in the premises, plus interest, all costs incurred, attorney's fees, and all general and equitable relief that the court deems fit and proper.
