Man alleges Aetna Life Insurance Co. wrongfully denied benefits

NEW ORLEANS – A Kenner man alleges he was wrongfully denied disability benefits.

John F. Jackson filed a complaint on Oct. 25 in the U.S. District Court for the Eastern District of Louisiana against Aetna Life Insurance Co. alleging that the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he has suffered damages for not receiving his benefits under the life insurance waiver of premium policy. The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly denied his claim for accelerated death benefits and abused its discretion in denying his claim for such benefits.

The plaintiff requests a trial by jury and seeks compensation for all benefits due, plus prejudgment and post-judgment interest, attorney fees, costs of suit and for all other relief as the law may provide. He is represented by James F. Willeford and Reagan L. Toledano of Willeford & Toledano in New Orleans.
