Blue Water Shipping Co. accused of breaching contract in shipment of soybean meal

NEW ORLEANS – Two corporations allege a Metairie company did not properly handle a cargo and caused delays.

Agribusiness United DMCC and Agribusiness United North America Inc. filed a complaint on Oct. 28 in the U.S. District Court for the Eastern District of Louisiana against Blue Water Shipping Co. Inc. alleging breach of contract and other counts.

According to the complaint, the plaintiffs allege that Agribusiness United DMCC and Agribusiness United North America Inc. hired defendant to arrange services for soybean meal to be loaded on a vessel in 2012. As a result of loading delays, the plaintiffs allege they sustained losses in vessel demurrage, extra costs incurred for failure for a timely inspection, shortages of cargos, and extension penalties. The plaintiffs hold Blue Water Shipping Co. Inc. responsible because the defendant allegedly did not arrange for a federal grain inspection service holds inspection and failed to obtain a phytosanitary certification.

The plaintiffs seek judgment against the defendant for compensatory and punitive damages, attorneys' fees, costs and all other relief as the court deems just. They are represented by L.
