Workers accuse janitorial service of failing to pay overtime

NEW ORLEANS — Five workers have filed a class action lawsuit against a New Orleans janitorial service, alleging violation of workers compensation acts.

Darwin Escobar, Rigoberto Garcia, Selvin A. Portillo, Gustavo A. Reyes Ramirez, and Selvin Vasquez filed a complaint, individually and on behalf of all others similarly situated, Oct. 26 in U.S. District Court for the Eastern District of Louisiana against Ramelli Group LLC, Ramelli Janitorial Service Inc., Robert C. Ramelli and K.C. Staffing LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs routinely worked more than 40 hours per week for three years prior to the filing of this complaint, without receiving overtime pay. The plaintiffs allege the defendants failed to pay them overtime compensation at the rate of one and one-half times their regular hourly rate for hours worked in excess of 40 per week as required by FLSA.

The plaintiffs seek trial by jury, judgment for unpaid overtime wages, liquidated damages, pre-judgment and post-judgment interest, attorney fees and court costs and for all other appropriate relief. They are represented by attorneys Daniel B. Davis and Randall E. Estes of Estes Davis Law LLC in Baton Rouge, by Gabriel O. Mondino of Burgos & Associates LLC in New Orleans, and by Matthew T.
