Subcontractor accuses Traverles insurance of violating Miller Act

LAFAYETTE — A heavy equipment subcontractor is suing Travelers insurance, alleging failure to pay its subcontractors.

Tanner Heavy Equipment Co. LLC filed a lawsuit Oct. 28 in U.S. District Court for the Western District of Louisiana against Travelers Casualty and Surety Company of America, alleging failure to comply with its bond under the provisions of the Miller Act.

According to the complaint, Tanner has performed work on a machine gun range in Fort Polk, Louisiana, that it subcontracted from Jamco Ventures LLC with USAED. To date, the suit says, Tanner has not received full payment of $385,439.99. 

The plaintiff alleges Travelers was obligated, pursuant to the bond, to pay Tanner for the completion of the work for which Jamco Ventures has failed to make payment.

Tanner Heavy Equipment seeks trial by jury, an order this complaint be deemed good and sufficient, judgment for damages, plus penalties and interest, attorney fees and costs, and all other equitable relief.
