Seaman seeks $10 million in damages from three companies after injury on vessel

NEW ORLEANS – A Mississippi man employed as a seaman alleges an on-the-job injury led to an amputation.

Michael Dant filed a complaint on Nov. 4 in the U.S. District Court for the Eastern District of Louisiana against Bertucci Contracting Co. LLC, Bertucci Marine LLC and Crosby Tugs LLC alleging negligence.

According to the complaint, the plaintiff alleges that in Oct. 20, he working aboard the defendants' M/V Capt. Chris when he was severely injured after his foot was crushed on the back deck of the vessel. The suit states that the injury has led to an amputation of his leg below the knee resulting in physical and mental pain, loss of bodily function and embarrassment.

The plaintiff holds Bertucci Contracting Co. LLC, Bertucci Marine LLC and Crosby Tugs LLC responsible because the defendants allegedly failed to properly train and instruct their crew on board their vessel, failed to maintain the vessel adequately and negligently allowed a dangerous slip/fall hazard to exist on the vessel.

The plaintiff requests a trial by jury and seeks monetary relief of $10 million for damages and an additional $100,000 for lost wages and maintenance and cure benefits, plus interest, costs and disbursements of this action. He is represented by C. Arlen Braud II, Michelle O. Gallagher and Steven D. Jackson of Braud & Gallagher in Mandeville.
