Venable Fabricators Inc. alleges Hypertherm's negligence caused loss of production

LAFAYETTE – A Rayne business has filed suit against a thermal/plasma manufacturer over allegations it failed to train its representatives.

Venable Fabricators Inc. filed a complaint on Dec. 22 in the U.S. District Court for the Western District of Louisiana, Lafayette-Opelousas Division against Hypertherm Inc. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Feb. 4, 2016, plaintiff accepted defendant's proposal for the sale and installation of equipment for $70,613, which wasn't completed until May. The plaintiff holds Hypertherm Inc. responsible because the defendant allegedly failed to timely deliver and install the equipment and failed to properly train its representatives and agents. As a result of defendant's alleged negligence, the plaintiff claims it suffered damages for loss of expenditures for defendant's equipment and services, loss of production and income.

The plaintiff requests a trial by jury and seeks compensation in an amount reasonable under the premises, plus penalties, interest, attorney's fees and costs and all other relief that are just and equitable. It is represented by Gilbert H. Dozier in Lafayette.
