Disabled employee alleges claims administrator failed to pay benefits

NEW ORLEANS — A disabled employee is suing her insurance company, alleging breach of an employee benefits contract.

Audrey Walker filed a complaint Jan. 3 in U.S. District Court for the Eastern District of Louisiana against Life Insurance Company of North America, alleging violation of the Employee Retirement Income Security Act.

According to the complaint, Walker has suffered monetary damages for not receiving her benefits under the long-term disability (LTD) insurance plan sponsored by her employer, West Jefferson Medical Center. The plaintiff alleges the defendant has failed to establish and follow reasonable claims procedures and failed to provide a full and fair review of her claim and appeal.

Walker seeks trial by jury, an order granting relief from the defendant for benefits due under the LTD plan, costs of litigation, attorney fees and pre-judgment interest. She is represented by attorney Edward A. Doskey of Doskey Law PLC in New Orleans.
