Consumer alleges Secure Asset Recovery Inc. implied threat of lawsuit in collection practices

BATON ROUGE – A consumer alleges a debt collector's actions caused stress and anxiety.

Camala Ward filed a complaint on Jan. 5 in the U.S. District Court for the Middle District of Louisiana against Secure Asset Recovery Inc., doing business as SAR & Associates; Recovera Inc.; and Alan Alvarez alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that after an account allegedly went into default, the defendants purchased said account for the purpose of collecting it. As a result of defendants' alleged acts, the plaintiff claims a suffering of intrusion in the way of fear, anxiety, stress, sleeplessness and/or distraction from normal life. The plaintiff holds Secure Asset Recovery Inc., doing business as SAR & Associates; Recovera Inc.; and Alvarez responsible because the defendant allegedly negligently implicated that plaintiff would soon be sued if plaintiff failed to settle the account.

The plaintiff requests a trial by jury and seeks compensation for actual, statutory and punitive damages, attorney's fees, costs and such other relief as the court deems just and proper. The plaintiff is represented by Denis E. Vega of Law Offices of Denis E. Vega in Metairie.
