NEW ORLEANS – A man alleges he was injured by a medical device.
Eido Depreo and Eileen Depreo filed a complaint on Jan. 6 in the U.S. District Court for the Eastern District of Louisiana against Howmedica Osteonics, doing business as Stryker Orthopaedics, et al. alleging negligence and other counts.
According to the complaint, the plaintiffs allege that on July 4, 2010, plaintiff Eido Depreo was implanted with a Rejuvenate Modular hip stem on his left hip, which will be explanted on Feb. 17, 2017. As a result of defendants' alleged defective implantation device, he claims has suffered further injuries. Plaintiff Eileen Depreo, claims damages as a result of loss of services and/or consortium.
The plaintiffs hold Howmedica Osteonics, doing business as Stryker Orthopaedics, et al. responsible because the defendants allegedly negligently manufactured an unreasonably dangerous hip stem.
The plaintiffs request a trial by jury and seek compensatory and statutory damages, attorneys' fees, prejudgment interest and costs of suit, restitution and disgorgement of profits and other relief as the court may deems just and proper.
