BATON ROUGE – A man has filed suit against a Livingston Parish Sheriff's Office sergeant after the use of a K-9 during a traffic stop.
Brent Mironelle Lee, individually and on behalf of his minor children Bre'Unisty Lee and Jamal Lee, filed a complaint on Jan. 11 in the U.S. District Court for the Middle District of Louisiana against Continental Casualty Co., Sheriff Jason Ard and Sgt. Carl Childers alleging deprivation of civil rights, assault and battery and other counts.
According to the complaint, the plaintiff alleges that on Jan. 11, 2016, under the direction of Childers, he was attacked by K-9 Apache for an excessive amount of time after a traffic stop on Florida Boulevard in Denham Springs. The suit states the plaintiff initially did not stop when the traffic stop was initiated and instead drove to another area he believed to be safer. Plaintiff alleges he suffered severe physical injuries and was required to be hospitalized. The plaintiff holds Continental Casualty Co., Ard and Childers responsible because defendant Childers allegedly failed to observe or negligently allowed the aggressive behavior of the dog and failed to timely end the attack.
The plaintiff requests a trial by jury and seeks award for damages, punitive damages, costs and attorney’s fees with interest, along with any other just and equitable relief.
