Man accuses town of Blanchard, law enforcement officers of false arrest, defamation

BLANCHARD – A Blanchard man claims he was falsely arrested after an argument with his wife.

David Miller filed a complaint on Jan. 12 in the U.S. District Court for the Western District of Louisiana against the town of Blanchard, Officer Gerald Allen and Chief Gary Presswood alleging false arrest, false imprisonment, failure to train, defamation and other counts.

According to the complaint, the plaintiff alleges that on Sept. 14, 2015, he was illegally arrested and charged with the offense of domestic abuse battery: child endangerment. The suit states his wife's mother had called 911 to do a check on the residence after receiving calls from the plaintiff's children. The suit states he was later exonerated of all charges.

The plaintiff holds the town of Blanchard, Allen and Presswood responsible because defendant Allen allegedly concealed the fact that the affidavit of probable cause contained a statement that never occurred and defendants Presswood and the town of Blanchard failed to ensure that defendant Allen was properly trained.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, attorneys' fees and costs and such other relief as may be just and appropriate. He is represented by Elton B. Richey Jr. and Claude M. Comeau of Elton B. Richey & Associates LLC in Shreveport.
