Dodge owners allege fraudulent software was installed in trucks for emissions tests

BATON ROUGE – Two owners of Dodge Eco Diesel pickup trucks claims the manufacturer misrepresented the vehicles' true emissions levels.

Bret Rivero and Jamie Varnado, individually and on behalf of all others similarly situated filed a complaint on Jan. 12 in the U.S. District Court for the Middle District of Louisiana against FCA US LLC alleging breach of express warranty, unjust enrichment and other counts.

According to the complaint, the plaintiffs allege that their trucks had software installed that reduced the amount of nitrogen oxide that was emitted during emissions tests. The suit states the vehicles emitted more pollutants than emissions laws allow. The plaintiffs hold FCA US LLC responsible because the defendant allegedly intentionally concealed and misrepresented the true emissions levels of the subject vehicles.

The plaintiffs request a trial by jury and seek certification of the proposed class, appointing of plaintiffs’ counsel as class counsel, revocation of acceptance, litigation costs and all other relief as may be appropriate.
