2138 Mag alleges Cimarron Underground caused damage to property

NEW ORLEANS – A commercial rental building owner alleges the property was damaged by construction done on a neighboring property.

2138 Mag LLC filed a complaint on Jan. 19 in the U.S. District Court for the Eastern District of Louisiana against Cimarron Underground Inc. and Zurich American Insurance Co. alleging strict liability and negligence.

According to the complaint, the plaintiff alleges that during defendant Cimarron's construction work next to plaintiff’s property at 2138 Magazine St., it damaged antique tile and mortar work and as well as caused structural damage at plaintiff's property. To date, the plaintiff alleges no repairs or compensation have been made by the defendants.

The plaintiff requests a trial by jury and seeks judgment against the defendants, declaring that they are liable to plaintiff for full and fair compensatory damages, award for costs and attorneys’ fees with legal interest.
