Man alleges he was injured when a generator fell on his head

NEW ORLEANS – A Lafourche Parish couple alleges the husband was injured while loading a generator.

Devin Barrios and Megan Barrios filed a complaint on Jan. 24 in the U.S. District Court for the Eastern District of Louisiana against Centaur LLC, Circle LLC and United Bulk Terminals Davant LLC alleging negligence.

According to the complaint, the plaintiffs allege that on Jan. 25, 2016, plaintiff Devin Barrios was employed by Centaur as a Jones Act Seaman assigned to work on a barge owned by Circle. The suit states that the plaintiff was offloading tools, a generator and equipment from United Bulk's crew boat when the boat separated from the barge and caused plaintiff to fall into the river, followed by a generator. The suit states the generator fell into his head, causing him to sustain injuries that resulted in physical and mental pain, disability and medical expenses.

The plaintiffs holds Centaur LLC, Circle LLC and United Bulk Terminals Davant LLC responsible because the defendants allegedly failed to provide a safe ingress and egress, failed to provide proper equipment and failed to properly secure the vessel during disembarking.

The plaintiffs request a trial by jury and seek judgment against the defendants for damages that are reasonable under the premises, costs of these proceedings and for all such other just and equitable relief. They are represented by Joseph L. Waitz III, Mary W. Riviere, Hunt Downer and David C. Pellegrin Jr. of Waitz & Downer in Houma.
