John J. Hainkel Home & Rehab Center accused of wrongfully terminating employee

NEW ORLEANS – A Jefferson Parish man alleges he was wrongfully terminated after a hospital stay.

David S. Bedell filed a complaint on Jan. 26 in the U.S. District Court for the Eastern District of Louisiana against New Orleans Home for Incurables Inc., doing business as John J. Hainkel Home & Rehab Center, citing the Americans with Disabilities Act, Family and Medical Leave Act and the Louisiana Employment Discrimination Law.

According to the complaint, the plaintiff alleges that on June 15, 2016, he was illegally terminated from his employment, just less than three months after he was hospitalized for heart issues and less than two months after his intermittent FMLA request. The plaintiff holds New Orleans Home for Incurables Inc., doing business as John J. Hainkel Home & Rehab Center, responsible because the defendant allegedly subjected him to adverse employment actions by discriminating and retaliating against him because of his disability and for exercising his rights under the FMLA. The plaintiff alleges he suffered loss of income and benefits, payment of insurance, mental anguish and various expenses.

The plaintiff requests a trial by jury and seeks compensation for damages in an amount reasonable in the premises, plus interest, litigation costs, and all other equitable relief deemed appropriate by the court.
