Man accuses federal government of negligence after accident with USPS employee

NEW ORLEANS – A Jefferson Parish resident alleges he was injured in a collision with a postal service employee.

Julio Hernandez-Perez filed a complaint on Jan. 29 in the U.S. District Court for the Eastern District of Louisiana against United States of America alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 28, 2016, he was driving his vehicle in a westerly direction on Navarre Avenue, in the Parish of Orleans when suddenly and without warning a vehicle being operated by Nathaniel Sartin, an employee of United States Postal Services, sideswiped plaintiff's vehicle, causing him to sustain personal injuries and property damage. The plaintiff holds United States of America responsible because the defendant allegedly carelessly attempted to take a wide right turn on to Canal Boulevard, failed to maintain a proper lookout and failed to exercise due care and caution for the safety of other motorist.

The plaintiff requests a trial by jury and seeks judgment against the defendant, in the full sum of $18,014.14 to compensate his damages and all other general and equitable relief that the law may allow. He is represented by Ivan A. Orihuela of Riguer Silva LLC in Kenner.
