Deckhand claims unsafe work environment on Captain Bill caused injuries

NEW ORLEANS – A deckhand alleges an unsafe condition on a vessel caused him to injure his back.

Danny Brian Weeks II filed a complaint on Feb. 10 in the U.S. District Court for the Eastern District of Louisiana against Western Rivers Boat Management LLC, Quality Marine, Ozark Transportation Co. LLC, et al. alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 15, 2014, he was employed by the defendants as a deckhand and member of the crew of their vessel, the Captain Bill. While performing his task unassisted, he alleges he sustained personal injuries to his lower back, resulting in loss wages and benefits, pain and suffering and medical expenses. The plaintiff holds Western River Boat Management LLC, Quality Marine, Ozark Transportation Co. LLC, et al. responsible because the defendants allegedly failed to correct an unsafe condition of which they knew or should have known and failed to provide enough personnel to safely complete the task.

The plaintiff requests a trial by jury and seeks judgment against defendants in the total sum of $500,000, plus interest, attorneys’ fees, all costs of these proceedings, and for all other general, equitable relief.
