Woman alleges Midland Funding, Eaton Group Attorneys sent misleading letter

BATON ROUGE – A Prairieville resident has filed a class action against two debt collectors over allegations that it mailed her a misleading collection letter.

Lindsay Hays, individually and on behalf of all others similarly situated filed a complaint on Feb. 15 in the U.S. District Court for the Middle District of Louisiana against Eaton Group Attorneys LLC and Midland Funding LLC alleging that they violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on May 31, 2016, she received a collection letter from defendants inviting her to explore a voluntary repayment plan and attached a consent judgment and a form provide financial and employment information. The plaintiff holds Eaton Group Attorney LLC and Midland Funding LLC responsible because the defendants allegedly intended to use the consent judgment to obtain repayment of the alleged debt though involuntary methods such as wage garnishment and seizure of funds and property.

The plaintiff requests a trial by jury and seeks an order certifying the class, appointing plaintiff as representative of the class and plaintiff's counsel as lead counsel, award for actual and statutory damages, costs and attorney’s fees and such other appropriate relief. She is represented by Samuel J. Ford, Galen M. Hair and David P. Vicknair of Scott, Vicknair, Hair & Checki LLC in New Orleans.
