Inmate alleges he was retaliated against by correctional officers

BATON ROUGE – An inmate at the Louisiana State Penitentiary is accusing two correctional officers of retaliation after he was allegedly injured by another inmate.

David Mitchell filed a complaint on Feb. 16 in the U.S. District Court for the Middle District of Louisiana against Sgt. Willie Thomas and Sgt. Clarence Roberts alleging negligence.

According to the complaint, the plaintiff alleges that on June 22, 2016, he was violently attacked by another inmate, causing him to sustain serious injuries to his head, back, neck and spine. The suit states Roberts allowed the inmate into the cell with the plaintiff. As a result, he claims he has suffered emotional and mental distress, pain and suffering and medical, hospital and pharmaceutical expenses. The plaintiff holds Thomas and Roberts responsible because the defendants allegedly conspired together to cause harm to plaintiff as a retaliation for the prior Prison Rape Elimination Act complaint of sexual harassment the plaintiff filed.

The plaintiff requests a trial by jury and seeks judgment against the defendants, litigation expenses and all other relief that the court may deem just, equitable, or proper. He is represented by Donna U. Grodner of Grodner & Associates in Baton Rouge.
