Man alleges New Orleans Electrical Pension and Annuity Plan wrongfully denied retirement benefits claim

NEW ORLEANS – A Mississippi man claims his claim for retirement benefits was unlawfully denied.

Robert G. Torrence Jr. filed a complaint on Feb. 21 in the U.S. District Court for the Eastern District of Louisiana against New Orleans Electrical Pension and Annuity Plan, Southern Benefits Administrators Inc., et al., alleging that the administrators violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on May 3, 2016, his application for retirement benefits and appeal were denied. The plaintiff holds New Orleans Electrical Pension and Annuity Plan, Southern Benefits Administrators Inc., et al. responsible because the defendant allegedly incorrectly applied the terms applicable for pension benefits, failed to properly maintain pension records and disregarded plaintiff’s credible and substantial proof of claim evidence.

The plaintiff requests a trial by jury and seeks an order that this complaint be deemed good and sufficient and after due proceedings there be judgment against the defendants and awarding all past and future benefits to which he is entitled and all other additional relief as the law may provide. He is represented by James F. Willeford and Reagan L. Toledano of Willeford & Toledano in New Orleans.
