Consumers allege RV they purchased is defective, has water damage

NEW ORLEANS – Two Texas residents allege a recreational vehicle they purchased has been damaged by water and has been out of service for more than a year.

Ryan C. Hardin and Robert J. Hardin filed a complaint on March 14 in the U.S. District Court for the Eastern District of Louisiana against Forest River Inc. and Southern RV LLC and Bank of the West alleging violation of Louisiana Redhibition Laws.

According to the complaint, the plaintiffs allege that on Oct. 9, 2014, Ryan C. Hardin and Robert J. Hardin purchased a new 2014 Forest River Cardinal for a total cost of more than $150,000. When delivered, the vehicle allegedly had water leaks causing the floors to rot and water damage to the RV's interior. The plaintiffs holds Forest River Inc. and Southern RV LLC and Bank of the West responsible because the defendants allegedly failed to perform repair work in a good and workmanlike manner so as to bring it into conformity with the warranties and failed and refused to buy back the defective vehicle.

The plaintiffs request a trial by jury and seek rescission of the sales contract, together with incidental and consequential expenses, award for diminution in value, litigation expenses and all other relief the court deems appropriate. They are represented by Richard C. Dalton of Richard C. Dalton LLC in Mandeville.
