LAFAYETTE – Four individuals allege they are owed the amount from a Medicare refund check that was incorrectly sent to a Baton Rouge health care facility.
Pauline O'Brien (deceased), by her children Lesa Frey, Kelly O'Brien, Victor O'Brien and Lucinda Youngblood filed a complaint on March 15, in the U.S. District Court for the Western District of Louisiana against Christus Health Southwestern Louisiana, doing business as Christus St. Patrick Hospital, and the U.S. Department of Health and Human Services and its Secretary Sylvia Matthews Burwell over allegations they are owed a refund check.
According to the complaint, the plaintiffs allege that on Jan. 8, 2016, they entered into a settlement claim with Christus St. Patrick. The suit states that there was a Medicare refund payment that was incorrectly made to Christus Health instead of the plaintiffs for $8,077.76. The plaintiffs hold the defendants responsible because the defendants allegedly failed and refused to issue the check for the said amount.
The plaintiffs request a trial by jury and seek judgment against defendants in the full sum of $8,077.76, together with legal interest, all costs of these proceedings and for such sums as the law may provide.
