NEW ORLEANS – A Franklinton man alleges a St. Tammany Parish judge violated his constitutional rights.
John D. Allen filed a complaint on March 15 in the U.S. District Court for the Eastern District of Louisiana against Allison H. Penzato alleging that the judicial district judge violated the Fifth, Sixth and Eighth Amendments of the U.S. Constitution.
According to the complaint, the plaintiff alleges that the defendant allegedly proceeded to conduct a criminal hearing and caused to issue criminal arrest warrant in 2016, despite having no subject matter jurisdiction to any charges against him and sentenced him to serve 30 days in jail without bond.
The plaintiff holds Penzato responsible because he alleges that as a result of defendant's unlawful actions, he has suffered damages to his reputation, loss of business clients and revenue, pain and suffering and mental anguish.
The plaintiff requests injunctive relief commanding defendant to rescue herself from all cases in which he is a party, costs of this litigation and all other just and appropriate relief. He is representing himself.
