SHREVEPORT – A Caddo Parish individual and a Keithville corporation are accused of misusing a Wisconsin company's software.
Rockwell Automation Inc. filed a complaint on March 17 in the U.S. District Court for the Western District of Louisiana, Shreveport Division against Ronald J. Montgomery and Custom Control & Design LLC alleging fraud, breach of contract, copyright infringement and unfair trade practices.
According to the complaint, the plaintiff alleges that it sold to defendants its Toolkit software package at a discount. The plaintiff holds Ronald J. Montgomery and Custom Control & Design LLC responsible because the defendants allegedly knowingly allowed plaintiff's license to be used by unauthorized users to download plaintiff's software on multiple occasions without registration and resold plaintiff's Toolkit software to a competitor and its authorized distributors.
The plaintiff requests a trial by jury and seeks all damages, attorneys’ fees and costs, interest, a temporary and permanent injunctive basis to stop misusing plaintiff's Toolkit software and such other and further relief as the court deems just and equitable.
