Consumer claims Janeway Law Firm sent misleading letters regarding alleged debt

LAFAYETTE – A Lafayette Parish consumer alleges a debt collector sent misleading letters.

Curt Dupre III filed a complaint on March 16 in the U.S. District Court for the Western District of Louisiana, Lafayette Division against Janeway Law Firm PC alleging that the debt collector violated the debt validation provisions of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in March 21, 2016, he received a collection notice letter from defendant stating that the amount of the alleged debt he owed as of that date was $45,941.27 and a notice of acceleration with the full balance of $46,181.10. 

The plaintiff holds Janeway Law Firm PC responsible because the defendant allegedly failed to state that plaintiff must request the address of the original creditor and that the defendant's letters are misleading because they report two different balances.

The plaintiff requests a trial by jury and seeks all damages, reasonable attorneys’ fees and costs, interest and such other and further relief as the court may deem proper. He is represented by Katherine Z. Crouch of Crouch Law LLC in New Orleans.
