Lafayette man claims officer slammed him to ground during traffic stop

LAFAYETTE — A motorist is suing officer Derrick Miles, interim police chief Reginald Thomas and their employer Lafayette City-Parish Consolidated Government, citing alleged unreasonable searches and seizures.

Irvin M. Escort filed a complaint on April 2 in the U.S. District Court for the Western District of Louisiana against the defendants alleging that they violated the Fourth and 14th Amendments of the U.S. Constitution.

According to the complaint, the plaintiff alleges that, on April 3, 2016, he was arrested and detained by defendant Miles due to an alleged illegal U-turn. As a result of defendant Miles' unlawful use of excessive force, plaintiff was deprived of his life and liberty and was caused to suffer significant injury, emotional distress and lost wages. The plaintiff holds Miles, Thomas and their employer responsible because Miles allegedly failed to adequately provide medical care or protect the interests of plaintiff before physically slamming him to the ground.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, plus interest, court costs and expert fees and such other and further legal and equitable relief. He is represented by J. Clay LeJeune of J. Clay LeJeune, Attorney at Law LLC in Lafayette.
