NEW ORLEANS – A Mississippi couple claims the husband was injured due to exposure to chemicals used in the cleanup of the Deepwater Horizon spill.

Allen Walker and Roxanne Walker filed a complaint on April 7 in the U.S. District Court for the Eastern District of Louisiana against BP Exploration & Production Inc., BP America Production Co. and BP PLC alleging negligence and other counts.

According to the complaint, Allen Walker is a scuba diver and continued to dive in Gulf waters believing it to be safe. He alleges he came into contact with hydrocarbons and dispersants beginning May 20, 2010, and that as a proximate result of his exposure to oil, dispersants, and/or other hazardous chemicals, he has suffered personal injuries. Roxanne Walker alleges she has and will have a loss of consortium due to the injuries to her husband.

The plaintiffs holds BP Exploration & Production Inc., BP America Production Co. and BP PLC, et al. responsible because the defendants allegedly recklessly used chemical dispersants that are more toxic than others and failed to adequately warn plaintiffs of the harmful effects of crude oil and chemical dispersants.

The plaintiffs request a trial by jury and seek compensatory and punitive damages, plus interest, attorney's fees, litigation costs and such other relief that are just and proper.

They are represented by Michael G. Stag, Merritt E. Cunningham, Ashley M. Liuzza, Stephen H. Wussow and Matthew D. Rogenes of Smith Stag LLC in New Orleans and Kelley B. Stewart, Michael J. Ryan, Joseph J. Slama, Jesse S. Fulton, Kevin A. Malone and Carlos A. Acevedo of Krupnick, Campbell, Malone, Buser, Slama, Hancock, Liberman PA in Fort Lauderdale, Florida.
