NEW ORLEANS – A St. James Parish man alleges a St. Rose business is not accessible to the disabled.

Milton Cayette filed a complaint on April 18 in the U.S. District Court for the Eastern District of Louisiana against Redman Gaming of Louisiana LLC alleging that the property owner violated Title III of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that on Nov. 21, 2016, he visited defendant's facility and experienced serious difficulty accessing the goods and utilizing the services offered therein because he uses a wheelchair. The plaintiff holds Redman Gaming of Louisiana LLC responsible because the defendant allegedly failed to provide a restroom that is accessible to and usable by individuals with disabilities and the sales and service counter is too high.

The plaintiff seeks an order directing defendant to alter the property to make it accessible to and useable by individuals with mobility disabilities, award attorneys’ fees, costs and other expenses and all further relief as it deems necessary. He is represented by Andrew D. Bizer, Garret S. DeReus and Marc P. Florman of Bizer & DeReus LLC in New Orleans.
