NEW ORLEANS – A Houma business is alleged to have failed to pay for equipment.
Banc of America Leasing & Capital LLC filed a complaint on April 24 in the U.S. District Court for the Eastern District of Louisiana against Matherne Instrumentation Specialists Inc. alleging that the borrower failed to fulfill its contractual obligations under the terms of the agreement.
According to the complaint, the plaintiff alleges that in July 8, 2014, defendant's President Chad Matherne executed a master security agreement to facilitate the purchase of certain equipment from Mazak Corp., which assigned all rights to the plaintiff. As of Jan. 19, 2017, defendant allegedly still owed an estimated $138,547.63. The plaintiff holds Matherne Instrumentation Specialists Inc. responsible because the defendant allegedly failed to make payments for the said amount.
The plaintiff seeks judgment against the defendant for all amounts owed, costs and expenses, attorney's fees and all other relief that the court may deem appropriate. It is represented by J. Dalton Courson of Stone Pigman Walther Wittmann LLC in New Orleans.
