Encore Nighclub alleged to have unlawfully intercepted boxing match

NEW ORLEANS – A New Orleans bar and night club is accused of unlawfully broadcasting a boxing match.

J&J Sports Productions Inc. filed a complaint on April 29 in the U.S. District Court for the Eastern District of Louisiana against Mallet Enterprises Inc., doing business as Encore Nightclub and also known as Encore Nite Club, Deirdre Mallet and Gloria Mallet alleging that they violated the Communications Act and the Cable & Television Consumer Protection and Competition Act.

According to the complaint, in May 3, 2014, plaintiff was the exclusive commercial domestic distributor of the Floyd Mayweather Jr. v. Marcos Rene Maidana WBC Welterweight Championship Fight Program. The plaintiff alleges that it has suffered damages for not receiving royalty payments for the said program. 

The plaintiff holds Mallet Enterprises Inc., doing business as Encore Nightclub and also known as Encore Nite Club, Deirdre Mallet and Gloria Mallet responsible because the defendants allegedly willfully directed their employees to intercept and broadcast plaintiff's program on their premises without plaintiff's permission and/or authorization.

The plaintiff seeks statutory damages in the sum amount of $170,000, attorney’s fees, costs of suit and all other relief as the court may deem just and proper. It is represented by Ronnie J. Berthelot of The Berthelot Law Firm LLC in Baton Rouge.
