Samuel’s Blind Pelican accused of broadcasting sports event without authorization

NEW ORLEANS – A New Orleans establishment is alleged to have unlawfully broadcasted a boxing match in 2014.

J&J Sports Productions Inc. filed a complaint on April 29 in the U.S. District Court for the Eastern District of Louisiana against 3705 Iberville LLC, doing business as Samuel’s Blind Pelican and also known as The Blind Pelican, Samuels Blind Pelican Taco and Beer and Samuels Avenue Beer Pub; Steven Louis Seeber; and Karen Brown alleging that the club operators violated the Communications Act and the Cable & Television Consumer Protection and Competition Act.

According to the complaint, in May 3, 2014, plaintiff was the exclusive commercial domestic distributor of the Floyd Mayweather Jr. v. Marcos Rene Maidana WBC Welterweight Championship Fight Program. The plaintiff alleges that it has suffered damages for not receiving royalty payments for the said program. The plaintiff holds 3705 Iberville LLC, Seeber and Brown responsible because the defendant allegedly unlawfully intercepted and broadcasted plaintiff's program on their premises without plaintiff's permission and/or authorization.

The plaintiff requests a trial by jury and seeks statutory damages in the sum amount of $170,000, attorney’s fees, costs of suit and all other relief as the court may deem just and proper. It is represented by Ronnie J. Berthelot of The Berthelot Law Firm LLC in Baton Rouge.
