Equipment leasing company sues towing company for amounts due

NEW ORLEANS — A leasing company is suing Tony’s Towing Inc., Lisa James and Tony James, alleging that they breached an equipment financing agreement.

Financial Pacific Leasing Inc., based in Washington state, filed a complaint on May 3 in the U.S. District Court for the Eastern District of Louisiana against the lessee and guarantors alleging that they failed to fulfill their contractual obligations.

According to the complaint, the plaintiff alleges that, on Dec. 23, 2014, plaintiff leased certain equipment to defendants for a monthly payment of $2,404.31 payable in 36 months. As of April 26, 2017, the total amount of $25,258.43 allegedly remains due and owing. The plaintiff holds the defendants responsible because, despite plaintiff's demand for payment, they allegedly failed and refused to make payments for the said amount.

The plaintiff requests a trial by jury and seeks payments for all amounts owed, plus interest, attorneys' fees and costs and all other relief as is just and equitable. It is represented by Richard A. Aguilar and Mark J. Chaney III of McGlinchey Stafford PLLC in New Orleans.
