Arkansas man says Smitty's Supply failed to pay various salaries and bonuses

NEW ORLEANS — A former executive is suing Smitty's Supply Inc., based in Roseland, citing alleged breach of employment agreement.

Stephen D. Kelley of Arkansas filed a complaint on May 4 in the U.S. District Court for the Eastern District of Louisiana against Smitty's Supply alleging that the employer violated the Louisiana Wage Payment Statutes.

According to the complaint, the plaintiff, who was employed by defendant at its Roseland facility as executive vice president and CFO from February 2014 to May 2016, alleges that he suffered damages for not receiving proper compensation under the agreement. The plaintiff holds the defendant responsible because it allegedly failed to provide a stock plan and to pay plaintiff's salary, incentive and severance pay.

The plaintiff requests a trial by jury and seeks judgment in plaintiff's favor for all amounts due to him under the agreement, plus interest and penalties, attorneys' fees and costs and all other relief that is just and equitable. He is represented by Thomas H. Kiggans, Karleen J. Green and Taylor Crousillac of Phelps Dunbar LLP in Baton Rouge.
