Enterprise Products Co. employee alleges unsafe work environment caused injuries

NEW ORLEANS – A Jones Act seaman claims his right ankle, right wrist, neck and back were injured in an accident while at work.

Von Smith filed a complaint on May 12 in the U.S. District Court for the Eastern District of Louisiana against Enterprise Products Co. alleging negligence.

According to the complaint, the plaintiff alleges that on March 10 he was employed by defendant aboard the M/V Diane when he experienced an accident that resulted in serious painful injuries. The plaintiff alleges he suffered physical, mental and emotional pain, loss of wages and fringe benefits, disability and medical expenses. 

The plaintiff holds Enterprise Products Co. responsible because the defendant allegedly failed to provide a reasonably safe place to work and failed to provide adequate personnel and equipment for the job.

The plaintiff requests a trial by jury and seeks all damages to which the plaintiff is entitled to recover plus legal interest, adequate maintenance and cure benefits, costs and expert fees and all other general and equitable relief.
